1. What changed in Texas hemp laws in 2026?

The Texas Department of State Health Services (DSHS) adopted new rules that change how THC is calculated in hemp products. The biggest update is the use of “Total THC”, which includes both Delta-9 THC and THCA.

2. What is “Total THC”?

Total THC refers to the combined amount of:

Delta-9 THC (active THC)
THCA (which converts into THC when heated)

All hemp products must now contain no more than 0.3% Total THC to be legally sold in Texas.

3. Is THCA flower still legal in Texas?

No. Under the new Total THC calculation, most THCA flower exceeds the legal limit and is no longer compliant for retail sale in Texas.

4. Can you still sell hemp flower?

Only hemp flower that tests at or below 0.3% Total THC is legal. This type of flower is typically non-psychoactive CBD hemp and is limited in availability.

5. Are edibles and vapes still legal?

Yes, hemp-derived products such as gummies, tinctures, and vapes are still legal as long as they:

Meet Total THC limits
Are properly tested and labeled
Comply with all DSHS regulations

6. When do these new rules take effect?

The updated rules take effect on March 31, 2026.

7. Why are some products no longer available?

Due to the new Total THC requirements, many previously available hemp products—especially smokable flower—no longer meet Texas compliance standards and have been removed from our inventory.
